What is Asbestos?

According to the US Environmental Protection Agency (EPA), asbestos is a name given to six fibrous minerals found in certain types of rock formations. Three of the minerals have been commonly used in building products as it is durable, fire retardant, resists corrosion, and insulates well. When asbestos is left intact it is not a health risk. However, because fibers made from these minerals are small and light, they can remain in the air for hours when disturbed or damaged. If inhaled, these fibers can infiltrate the lungs and increase the risk of developing lung cancer, mesothelioma, or asbestosis. Symptoms can take 20 -30 years to appear after being exposed to the asbestos fibers.
Asbestos was used by manufacturers and builders from the early 1900’s to the 1970’s. Over 3000 different commercial products may contain asbestos ranging from paper products to thermal insulation. Workers in shipbuilding, mining, milling and fabricating are among those that have experienced severe health problems as a result of working around asbestos fibers.

What is the Risk of Asbestos Exposure?

Almost everyone has been exposed to asbestos at some point of their life. It is usually only a danger however, to those that are exposed to it on a regular basis. Asbestos has been widely used in many different industries and products. It has been used in the building and construction trades as insulation materials, to strengthen cement and plastics and roofing. Shipbuilders have used asbestos to insulate boilers and pipes. Automobile manufacturers use asbestos in vehicle brake shoes and clutch pads.
In addition, asbestos has been found in vermiculite-containing garden products and some talc-containing crayons.

In the late 1970s, the U.S. Consumer Product Safety Commission (CPSC) banned the use of asbestos in wallboard patching compounds and gas fireplaces. In 1989, the U.S. Environmental Protection Agency (EPA) banned all new uses of asbestos; however, uses developed before 1989 are still allowed.
In June 2000, the CPSC determined that the asbestos fibers in talc containing crayons presented an extremely low risk to children. However, in spite of these findings, U.S. manufacturers of talc containing crayons voluntarily agreed to eliminate talc from their products.

In August 2000, the EPA conducted a series of tests to evaluate the risk to consumers that are exposed to asbestos from the use of gardening products that contain vermiculite. The EPA concluded that exposure to asbestos from some vermiculite products has only a minimal health risk to the public. They do recommend that consumers use vermiculite outdoors or in a well-ventilated area, keep vermiculite damp while using it, avoid bringing dust from vermiculite into the home on clothing, and use premixed potting soil.

In May 2008, a legislative bill, known as H.R. 3339, “issued a proposal to ban the use of all asbestos and increase federal funding for research of treatments to fight against asbestos related illnesses or conditions.”

Asbestos has been classified as a known carcinogen by the U.S. Department of Health and Human Services, the EPA, and the International Agency for Research on Cancer. Most health risk from asbestos exposure comes from repeated or long term exposure to asbestos containing products. However, asbestos related diseases have been diagnosed in patients with only brief exposure to asbestos. Overall evidence indicates that there may be no safe level of asbestos exposure.

Asbestos Related Diseases

The most dangerous asbestos fibers are too small to be visible to the naked eye. If these fibers are inhaled, they can remain and accumulate in the lungs. Asbestos can cause lung cancer, mesothelioma -a cancer of the lining of the chest and the abdominal lining, and asbestosis – irreversible lung scarring that can be fatal.
Symptoms of these diseases typically do not show up until years and even decades after exposure. It is very important to contact your doctor or healthcare provider if you may have been exposed to asbestos and develop any of the following symptoms:

Stages of Mesothelioma

Stage I – the cancer is confined to specific areas of the body, has not spread, and can sometimes be removed surgically or through other procedures.

Stages II and III – the cancer has advanced and unlikely to be cured. Treatment options during these stages of mesothelioma concentrate on relieving painful symptoms normally associated with mesothelioma cancer.

Stage IV – the cancer has spread to other tissues or organs of the body and a cure is not possible. Surgery, radiation therapy and chemotherapy may be used to diminish painful symptoms at this stage of mesothelioma cancer. Though a cure is not expected, diligent treatment procedures have been known to extend a patient’s life by several months.

Employers are required to pay overtime wages for hours worked over forty hours per week to all non-exempt employees. Wage and hour laws also cover when an employer is required to pay you. These are frequently referred to as “pay day” laws.

An employer must pay their employees on their regular payday. It is not allowed for the employer to hold the check for an extended period of time beyond their payday.
The second main area of employment law is worker’s compensation which an employer is required to provide to an employee who is injured on the job. Again, some states have established their own worker’s compensation employment laws, though Federal employment law will apply for all other states.

Worker’s compensation can also raise concerns about workplace conditions. Employers are required to provide a safe working environment. If an employer fails to provide adequate safety measures (such as equipment, exits, procedures, and training), then the employer can be fined by the United States Department of Labor’s Occupational Safety and Health Administration (OSHA) in addition to being required to compensate an employee for any injuries suffered.

Most federal workplace discrimination laws are enforced by the Equal Employment Opportunity Commission (EEOC). My name is Darren Miller and I would like to take a few moments to introduce myself and our law firm. I received my Bachelor of Science from Texas A&M University in 1992 after which I attended the University of St. Thomas where I received my Masters in Business Administration in 1993. I then went on to receive my Juris Doctor in 1997 from Texas Southern University’s Thurgood Marshall School of Law.

After a short time but with great success, I left that firm to start a new Firm with one of our associates, Ryan B. Bormaster, and legal assistant Aurora Martinez. In August of 2002 we opened the doors to D. Miller & Associates, PLLC and we have never looked back. In the beginning it was just myself, Ryan and a few support staff. Ryan B. Bormaster was born and raised in Houston, Texas. As a teenager he was active in the B’Nai B’rith Youth Organization and was a contributing member if Isadore Shapiro AZA. He graduated from Bellaire Senior High School and went on to receive his B.A. in Government and Philosophy from the University of Texas at Austin. He then attended Texas Southern University’s Thurgood Marshall School of Law where he graduated Cum Laude with his Juris Doctor. He is admitted to practice law before the Supreme Court of Texas and the United States District Courts for the Southern District of Texas. Eric B. Bormaster grew up in Houston, Texas and joined D. Miller & Associates, PLLC in 2003. Mr. Bormaster currently practices in the firm’s litigation section. Ramesh Raghuthaman Attorney At Law

Ramesh Raghuthaman is a trial attorney and one of the managing attorneys of D. Miller & Associates, P.L.L.C. Over the years, Mr. Raghuthaman has obtained millions of dollars for his clients, through aggressive and zealous representation. Mr. Raghuthaman received his law degree from Washington University in St. Louis in May of 2001. During law school, Mr. Raghuthaman was a participant in Washington University School of Law’s environment moot court He received his Bachelors of Arts in Political Science with Honors and a minor in Communications from Case Western Reserve University.

Mr. Raghuthaman is a local Houstonian and attended Strake Jesuit College Preparatory before leaving for college and graduate school. Madhu Sekharan Attorney At Law

I’m Attorney Madhu Sekharan. I joined D. Miller & Associates, P.L.L.C. soon after graduating from South Texas College of Law in Houston. I knew Attorney Darren Miller in high school, as we both attended James E. Taylor High School in Katy, Texas and he was the primary reason I joined the firm. I knew that he had his heart and mind in the right place. My primary practice areas are Mass Torts, Pharmaceutical Drugs, Toxic Torts, Consumer Law, Medical Malpractice, Personal Injury, and Employment Law (F.L.S.A.).

Since joining the law firm, I have worked on a variety of cases, including a large Mass Tort case involving the explosions that occurred at Formosa Plastics Corp. in Point Comfort, Texas in 2005. I also worked on a Mass Tort case stemming from the deadly 2005 blast at the British Petroleum (B.P.) Refinery in Texas City, Texas. As of July 2011, we are still in litigation on the Formosa Plastics case. Meanwhile, our law firm was able to resolve a large number of personal injury and property damage cases stemming from the B.P.-Texas City Refinery disaster.

Since 2010, I have primarily focused on another Mass Tort case, namely the B.P. Oil Leak case. Our firm represents well over a hundred clients on that case, including fishermen, deckhands, shrimp boat captains, oystermen, shrimpers, restaurant owners, hotel owners, and business owners. They have been severely hurt financially by the largest environmental disaster in our nation’s history, caused by the Deepwater Horizon explosion and the B.P. Oil Spill/Leak which followed. During 2011, I began working on our firm’s Nexium Pharmaceutical cases. At this time, we represent over a hundred clients on that matter involving the popular acid-reflux medication Nexium. Nexium can lead to a severe loss of bone density, osteoporosis, and fractures/bone breaks due to the blocking of calcium absorption. We have a television ad which began to air on several cable television channels in May 2011. Our law firm plans to continue signing many more clients on both the B.P. Oil Leak case and the Nexium Pharmaceutical case, especially during 2011-2012. I greatly enjoy my work every day and feel blessed to be in a position where I can help people that have been hurt physically, financially, and emotionally. Before attending law school, I attended the University of Texas at Austin. After graduating with a B.B.A. in Finance from U.T.-Austin, I worked for both Texas Commerce Bank and Bank United before rounding out my business education with an M.B.A. in finance from the University of Houston. While getting my M.B.A., I worked for Mr. Paul Hobby at Hobby Communications. I also completed a summer internship at Enron International. After earning my M.B.A. in Finance, I worked in Equity Research at Raymond James, with a focus on the Exploration and Production (E&P) sector. I also worked on analysis of the international crude oil market and the domestic natural gas market.

In my younger years, I grew up playing junior tennis. I was fortunate to qualify for and compete in State and National U.S.T.A. tennis tournaments as well as some pro satellite tennis tournaments. I am also an avid runner, having completed five Houston marathons. I still play tennis when I have the opportunity and it is truly a lifetime sport. I married my childhood sweetheart, Sreedevi Sekharan, and we have been blessed with two beautiful daughters, Lakshmi and Krishna.

I just wanted to let you know how helpful, professional and compassionate Mr. Ramesh Raghuthaman was when I found him in January of this year. All looked so bleak, I was just weeks away from losing my home to The Concord Bridge HOA, but Mr. Raghuthaman told to me to relax that he would take care of it and he did. There really appeared to be no hope. Any time I was feeling panicky and would call his office, he never put my calls off or sent me to his voice mail, he would talk to me and reassure me that everything was going to be okay and in the end it was. There were other attorneys that I spoke with before I found Mr. Raghuthaman but they only appeared to be interested in money and gave very little hope in helping me to keep my home.
